These terms apply to your use of mad.co.uk and madcomments irrespective of the delivery platform you use - e.g. desktop PC, laptop, mobile device, PDA or otherwise - and irrespective of how mad.co.uk and madcomments content is delivered to you - e.g. via web browser, WAP browser, email, SMS or otherwise. By registering you are agreeing to the terms and conditions below. You are responsible for bringing these terms and conditions to the attention of anyone who may access the material as a result of you.

mad.co.uk - terms and conditions

1. Access and Use

mad.co.uk is split into three sections. Areas that are:

  1. Accessible to all
  2. Accessible to registered users. In order to gain access to these areas, an online registration form must be completed.
  3. Accessible to paying subscribers only. For these areas, a valid mad.co.uk subscription must be held by the user. mad.co.uk subscriptions are sold on a single and multiple user basis, and should be used as such. mad.co.uk Full Access and mad.co.uk Express are single license subscriptions, and must only be used by the named user.
    If it is found that there is multiple usage of a single license subscription, this is considered to be a breach of license, and the subscription will be terminated immediately.
    mad.co.uk Corporate and mad.co.uk Academic subscriptions are sold as multiple user licenses, and should be used according to the agreement made when the subscription is set up.
  4. Complimentary online access to print magazine subscribers
    In order to gain access to their relevant magazine website, print magazine subscribers must activate their subscription by registering on mad.co.uk. This access is strictly limited for the use of the named subscriber only.
  5. Complimentary online access to other specified groups. There are certain professional bodies and associations whose members get discounted access to mad.co.uk.

mad.co.uk reserves the right to change which areas of the site are registration controlled, and which areas are accessible to paying subscribers only.

The material on the Site including, but not limited to the text, photos and graphics reproduced on it are protected by copyright, other intellectual property rights and all analogous rights.

The Site is owned by Centaur Media PLC. (Centaur) and neither the whole nor any part of it may be reproduced other than by downloading and viewing on a single CPU, and/or printing a single hard copy, for private or internal business use only. It is not to be otherwise reproduced, transmitted, or made available on a network, without the prior written permission of Centaur. All other rights are reserved.

The trade marks, logos and service marks shown on the Site, unless otherwise specified are the trade marks of Centaur. No rights are granted to use any of them without the written permission of Centaur. Centaur may at any time modify these terms and conditions. Any modifications will become effective on either the posting of the modified terms and conditions on the Site or notification to you.

2. Restrictions on Use

You may not use mad.co.uk for any unlawful purpose. Except as expressly set out above, you may not copy, reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive, publicly display or in any way commercially exploit any of the mad.co.uk content. Without limitation, you may not do any of the following without prior written permission from mad.co.uk (and neither may you allow a third party to do any of the same):

  1. redistribute any of the mad.co.uk content, including our headlines (including by using it as part of any syndication, content aggregation, news aggregation, library, archive or similar service); or
  2. remove the copyright or trade mark notice from any copies of mad.co.uk content made under these terms and conditions; or
  3. create a database in electronic or structured manual form by systematically and/or regularly downloading/printing and storing all or any of the mad.co.uk content; or
  4. deep link to, frame, spider, harvest or scrape the mad.co.uk content or otherwise access the mad.co.uk content for similar purposes; or
  5. use any machine, electronic, web based or similar device to read or extract the mad.co.uk content by automated or machine based means.

3. Paid for Subscriptions

mad.co.uk reserves the right to vary the areas of the site that are paid for, those that are to be registered for, and those that are free-of-charge.

4. mad.co.uk Subscriptions

We offer the following paid for subscriptions to mad.co.uk:

  1. mad.co.uk Full Access - these are sold on a monthly, quarterly and annual basis. This is an individual license, and must only be used by the named user.
  2. mad.co.uk Express - these are sold on quarterly and annual basis. This is an individual license and must only be used by the named user.
  3. mad.co.uk Corporate - these are sold as an annual subscription only. This a provides a multiple user license, starting at five users or more.
  4. mad.co.uk Academic - these are sold as an annual subscription only. mad.co.uk Academic subscriptions are only open to college / university staff and full time under-graduate students.

Any improper use of any subscription or breach of license, will result in immediate termination of the subscription with no refunds forthcoming. No refunds will be given if the subscriber does not use the service for the whole of the subscription period.

5. mad.co.uk free trials

A 7-day free trial is available to all new subscribers to mad.co.uk. This enables users to access the site before making any commitment to a paid subscription. To take up your 7-day free trial, you need to follow the subscriptions process on our website, entering in all your details and choosing a payment plan. This is so that your chosen subscription can begin automatically should you continue beyond the trial period. You will have immediate access to mad.co.uk as soon as you submit your free trial request, and you will be sent a confirmation email.

There is no obligation to continue a subscription beyond the free 7-day trial period. You can cancel at any time within the 7 days by emailing: customerservices@mad.co.uk. Your subscription will be cancelled and no payments will be taken. For all cancellations you will receive email confirmation of your cancellation within 24 hours. If you do not receive a confirmation, you must contact us urgently via email or telephone, as your request may not have been received. You can contact our Customer Services team on: 020 7970 4789.

If you decide not to cancel within the 7 days, your paid subscription will automatically begin, and your first payment will be debited at the end of the 7th day of your free trial, according to the payment plan you have chosen. For details of how to cancel paid subscriptions, please see section 6.

6. Payments

When you subscribe to mad.co.uk, you must provide us with complete and accurate payment information. You can pay by either credit or debit card. By submitting credit or debit card payment details to mad.co.uk, you agree to purchase a subscription using those payment details and on a continuous authority basis. Continuous authority means mad.co.uk will continue taking subscription payments until you tell us you no longer wish to subscribe. To cancel your continuous authority agreement, you must do so in writing by email or post. You can contact us in the following ways:

It is important that you include your full name, the email address you are registered with and details of the subscription you wish to cancel. You will receive written confirmation that your continuous authority agreement has been cancelled.

Any older browser versions may work but users could have limited browsing experience. Any payment information you send to us over the Internet is encrypted using 128 bit Secure Socket Layer technology. SSL is currently the preferred method to securely transfer credit card data over the Internet.

7. Refunds

We do not offer refunds on susbcriptions to mad.co.uk.

If we do not receive payment authorisation or any authorisation is subsequently cancelled, we may immediately terminate or suspend your access to any subscription content.

8. Privacy

Please refer to the Privacy policies.

9. Warranty and Liability

Centaur has used reasonable care and skill in compiling the content of the Site but neither it nor any third-party content provider makes any warranty, express or implied, as to the nature or accuracy of any material on the Site.

Centaur cannot accept liability (including liability for any indirect loss or loss of profits or turnover) for any particular material or the result of any use made of it.

10. Choice of Law and Jurisdiction

These terms and conditions shall be governed by, and construed in accordance with, English law.

To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.

For the exclusive benefit of mad.co.uk and to the extent possible in the applicable jurisdiction, mad.co.uk shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these terms and conditions are entered into in the course of your trade or profession, the country of the place of business in which you agreed to these terms and conditions or (if different) the country of your principal place of business.

11. Email Alerts

By subscribing to mad.co.uk you are agreeing to receive regular email communications which form part of your subscription package. We will also keep you informed of mad.co.uk offers and promotions, relevant to you by email and by post. To stop receiving emails from mad.co.uk, click on the relevant unsubscribe links in the emails you receive.

13. Changes to Terms and Conditions

mad.co.uk’s Terms and Conditions were last updated 25th January 2008. These replace any Terms and Conditions in existence before this time. mad.co.uk reserves the right to vary or amend these Terms and Conditions at any time without notice. Any such variation or amendment to these Terms and Conditions will be posted here.

1. Definitions

In these Terms and Conditions, the following words and phrases shall bear the following meanings:

  • ‘madcomments’ is a product owned and operated by mad.co.uk, whose registered office is at St. Giles House, 50 Poland Street, London, W1F 7AX and a subsidiary of Centaur Media PLC. (‘Centaur’).
  • ‘Material’ means data or information in any format, including without limitation text, images, photographs, graphics, video or sound material whether existing at the time of registration or not, published on madcomments, whether copyright of Centaur or of a third party and which is communicated or transmitted to the User in using madcomments.
  • ‘Personal Information’ means Personal Data as defined in the Data Protection Act 1998 as amended.
  • ‘User’ means any person who accesses or uses madcomments.

2. Introduction

By accessing or using any madcomments the User acknowledges and agrees to be bound by these Terms and Conditions.

The User agrees to fully comply with these Terms and Conditions, including the acceptance of liability as detailed in clause 4 and 6.

Each User is allocated a unique user name and password for the authorised use of the User only. These are not transferable, and the User shall keep them strictly confidential and secure. The User should notify Centaur immediately if any unauthorised use comes to its attention.

The User shall indemnify Centaur against any unauthorised use of his/her user name and password, including use by a third party where the User has allowed or facilitated that third party to have access to any Material, however so received.

The User shall indemnify Centaur against all costs, claims, demands or expenses incurred by or made against Centaur or madcomments as a result of any breach of these Terms and Conditions or howsoever arising.

3. Access to madcomments

In order to submit material to madcomments the User must register as a personal user via the unique user name and password. The User undertakes not to maliciously create additional registration accounts for the purpose of abusing the functionality of the site, or other users; nor to seek to pass its self off as another user.

Centaur reserves the right to prohibit access by person(s) to madcomments at its sole discretion at which time the agreement will terminate.

4. Condition of Use

The User may download the Material electronically, print extracts and make copies of these for its own personal and non-commercial use only. This does not include downloading, storing, transmitting, displaying, copying or distributing the Material, or extracts from it, in a structured manner or creating a database in any form comprising all or part of the Material.

The submission of Material by the User is on the following terms:

  1. The User grants Centaur a non-exclusive, non-transferable, perpetual, royalty-free, worldwide licence to publish or use the Material in any format, including in other products of Centaur. The licence shall include the right for any Users to take actions in accordance with clause 8.
  2. The User warrants to Centaur that all rights including intellectual property and moral rights in the Material submitted belong to the User or the User has received all necessary permissions to submit it to Centaur.
  3. The User warrants to Centaur that the Material submitted is not obscene, offensive, defamatory of any person or otherwise illegal.
  4. Centaur at its sole discretion reserves the right to not publish the Material in part or whole, make additions or deletions to, edit, crop or arrange the Material prior to publication. Centaur may do so without giving any reason but the User should note that Material that is off-topic or unnecessarily antagonistic is likely to be rejected. All comments are moderated before publication.
  5. Centaur shall make no payment for Material submitted and used under these Terms and Conditions

5. Data Protection and Privacy

Centaur takes the privacy of its Users seriously. It is committed to safeguarding the privacy of its Users. Please refer to Centaur's Privacy Policy.

6. Liability

The User acknowledges that any breach of a clause outlined in these Terms and Conditions which may cause damage or loss to Centaur and agrees to indemnify Centaur in full against any third party liabilities, claims, costs, loss or damage including consequential losses, incurred as a result of publishing Material submitted.

To the extent permitted by law Centaur, its agents or representatives shall have no liability whatsoever to the User for any direct, indirect or consequential loss or special loss or damage, cost or expense suffered or incurred by the User (whether arising in tort, contract or otherwise, and whether arising from the negligence, breach of contract, defamation, infringement of copyright or other intellectual rights) caused by use of madcomments or from the negligence of its employees or agents or licensors, and whether asserted against Centaur, madcomments or against any third party in relation to its use.

Centaur does not make any representation or give any warranty, either express or implied:

  1. in relation to any information, goods or services offered, accessed or obtained through madcomments;
  2. in relation to warrantees of title, non infringement of copyright or patent rights of others, merchantability, or fitness or suitability for any purpose;
  3. for the content, accuracy, integrity, lawfulness or otherwise of information on websites over which Centaur has no control;
  4. as to the suitability of the information and data on madcomments for any particular purpose;
  5. that the information and data on madcomments site is free of infection by computer viruses or other contamination.Centaur and its agents or representatives do not endorse or in any respect warrant any third party products or services by virtue of any advertisement, information, material or content referred to, or included on, or linked from or to madcomments.

madcomments does not purport to provide advice. Centaur is not responsible for Users taking or refraining from taking actions on the basis of information provided by madcomments. Although every care is taken in the preparation of information supplied by madcomments, Centaur is not responsible for any loss suffered as a result of any action taken or refrained from being taken as a result of any information contained in madcomments.

7. Trade Marks And Intellectual Property

All rights in ‘mad.co.uk’, ‘madcomments’, and other marks owned by Centaur are reserved.

All Material other than submitted by Users on madcomments is property of Centaur. Reproduction without Centaur's permission is prohibited. For such permission Users should e-mail the madcomments editor, Branwell Johnson, branwell.johnson@mad.co.uk

8. Miscellaneous

Users who wish to advertise on madcomments should email Elliot Shaw on elliot.shaw@mad.co.uk

Centaur reserves the right to remove, alter, change or vary madcomments at any time without notice.

Centaur shall endeavour to provide constant, uninterrupted access to madcomments but do not guarantee to do so and accept no responsibility or liability for any interruption or delay.

9. Applicable Law And Jurisdiction

The provision of madcomments is governed by the Laws of England and shall be subject to the jurisdiction of the English courts.

10. Variation

Centaur reserves the right to vary or amend these Terms and Conditions at any time without notice. Users should review these Terms and Conditions regularly as Users will be deemed to have accepted a variation in continuing to use the site after it has been posted.
